General Terms and Conditions of Sale
ARTICLE 1 – GENERAL
The purchaser acknowledges having read these terms and conditions before placing the order. The general conditions of sale apply exclusively to all the sales concluded for our products, property of the company OTG, as well for its own account as for that of its principals. All other conditions are only valid after written confirmation by the seller. By placing an order or accepting an offer from the seller, you accept these terms and conditions without reservation. Any terms and conditions not in accordance with our terms and conditions that the purchaser has formulated will be rejected unless we have expressly and in writing acknowledged their applicability. These terms and conditions may be modified at any time and without prior notice by OTG, the modifications then being applicable to all subsequent orders.
ARTICLE 2 – ORDERS
Orders are effective from the date of receipt of payment. The customer can be refunded if he wishes it, in the conditions of the article L 121-20-1. The company OTG commits to deliver the buyer as soon as possible. The buyer will be delivered according to the times mentioned on the website www.getjolt.com except in exceptional cases (postal strike, extraordinary event, etc.). However, the deadlines can be longer (for example depending on the periods of the year such as the period of Christmas), which the purchaser understands and accepts.
ARTICLE 3 – PRICES
The seller's price list does not constitute a sale. It can be modified unilaterally without prior information before the customer's purchase. The goods are invoiced at the agreed price within the limit of the option period and the general economic conditions (taxes, exchange rates, ...), at the time of delivery. All prices indicated on the seller's website are net prices in euros, including all taxes, excluding shipping costs, which will be indicated before the order is registered by the buyer. Prices may be subject to promotions, sales, and other price reductions.
ARTICLE 4 – PAYMENT
All payments are in Euros. The payment of the total price must be realized at the moment of purchase by the buyer. The sums paid can at no point be considered as a deposit or advance payment. To pay for his order, the buyer must have a credit card or a Paypal account. The payment by card or Paypal is fully secured by Secret Socket Layer (SSL) protocol. The encryption is encrypted in such a way that no one can access the data for dishonest purposes. The order will be shipped as soon as payment is confirmed. The purchaser guarantees to OTG that he has the necessary authorizations to use the method of payment which he has chosen, when registering the order form. The company OTG reserves the right to suspend or cancel any order and/or delivery, regardless of their nature and level of execution, in case of non-payment of any sum that would be due by the buyer or in case of payment incident. The company OTG reserves the right to request a photocopy of the ID card of the buyer and/or a proof of address for any order. As part of the fight against Internet fraud, your order information may be checked for verification.
ARTICLE 5 – CHOICE OF ITEMS
The buyer having acquainted with the products and their characteristics, marketed by the company OTG has under his only responsibility and according to his needs such as they beforehand determined them before any order, carried his choice on the products being the object of his order. In the event of unavailability, and without calling into question what is indicated in article 2, JOLT™ can provide a good or service of an equivalent quality and price.
ARTICLE 6 – WARRANTY
All products sold by JOLT™ are subject to warranty. This warranty applies only to products sold by JOLT™. This warranty is effective when the products are used in accordance with the recommendations and corresponding instruction manuals. Warranty periods are specified on the product sheets of www.getjolt.com.
In any case, the products are covered by a 2-year warranty on parts and labor.
• Intentional damage: intentional damage to the product
• Misuse, contrary to recommendations or instruction manual.
• Non-compliance with safety instructions
• Cosmetic damages
In the event of a failure or damage covered by the warranty that cannot be repaired, JOLT™ will replace the part or product with new if the part cannot be changed or repaired.
ARTICLE 7 – DELIVERY
Delivery time : All our products are in stock in our warehouse in France (we are not "dropshippers": we own and create our products, our brand and our supply chain). Your order is shipped within 2 business days maximum from our logistics center, unless otherwise indicated on the product sheet or when finalizing the order. From this moment, you will receive a tracking number from our delivery partner (Colissimo or DPD) in order to locate your package. Delivery is then generally made within 48h/72h maximum.
General rules : The products will be delivered to the address indicated by the buyer on the order form. If you are absent, a notice will be left in your letterbox, you can then reschedule a delivery or collect the ordered products in an establishment of your choice, and this within the time indicated by the carrier on the notice.
Delivery problems : The buyer must check the condition of the packaging of the goods, its contents and its operation on delivery, in presence of the carrier. Should the buyer have any doubt of any kind whatsoever, it is required: To apply the return procedure ( in particular to report the damage due, any claim and reserve) and to reject the goods by immediately issuing a report of anomaly to the deliveryman in charge. The buyer must report these incidents within 3 days following the rejection of the goods and this by stating the said claims or reservations.
Quality or compliance issues : In case of delivery of a product that does not correspond to the order (defective or non-compliant), the buyer must submit a claim within 5 days from the date of signature of the delivery note. Complaints must be addressed via the contact form and must include: The contact details of the buyer, the relevant order number, the product references, the reasons for the complaint. The return procedure will then be communicated to you. The products returned by the buyer must be returned within a maximum of 15 business days from the date of delivery, or the date of the return authorization.
ARTICLE 8 – RETENTION OF TITLE
In accordance with the law, the property of the goods will be transfered to the buyer only after full payment of the price in principal and accessory or cashing of the accepted cheques or other payments methods issued to settle the price. During the period from delivery to transfer of ownership, the risk of loss, theft or destruction shall be borne by Buyer. Failure by the Buyer to fulfill his payment obligations, for whatever reason, entitles the Seller to demand the immediate return of the goods delivered at the Buyer's expense and risk.
ARTICLE 9 – RIGHT OF WITHDRAWAL & RETURNS
Right of withdrawal :
The buyer has a legal right of withdrawal of 14 days from the day after he comes into possession of the product. He shall pay for the return costs. This right of withdrawal also applies to discounted products sold on www.getjolt.com
The refund will be made within 14 days from the time JOLT™ receives the returned product. The buyer will have informed JOLT™ beforehand of his decision to withdraw. This decision must be notified by the customer via the contact form. JOLT™ will inspect the returned product to validate its good condition.
Please refer to the warranty exclusions developed in Article 6 : The buyer must return the product in its original packaging, unused, with all its accessories, indicating the reason on the invoice.
The buyer will then be able to choose different options:
• a new delivery that respects the order
• repair of the defective product
• exchange of the product for a similar one
• cancellation of the order.
